What is CAA 2019 : Home Minister Amit Shah stated on Monday that Prime Minister Narendra Modi has fulfilled the commitment of the framers of our Constitution by officially announcing the enforcement of the Citizenship Amendment Act (CAA). Shah shared a document outlining the rules for implementing the CAA and emphasized that the Modi government has now notified the Citizenship (Amendment) Rules, 2024. In simpler terms, this means that the government has taken a significant step in putting the Citizenship Amendment Act into effect by establishing the specific rules and guidelines for its implementation. It has been notified before the lok sabha election.

On March 11, the Ministry of Home Affairs (MHA) announced new rules called the Citizenship Amendment Rules, 2024. These rules will make it possible to put into action the Citizenship Amendment Act (CAA), which was approved by the Parliament in 2019.

What is CAA 2019 (Citizenship Amendment Act)?

The Citizenship Act (CAA-19) was amended in 2019 to make it easier for some individuals to become citizens of India. This is a change for the benefit of Christians, Buddhists, Jains, Parsis, Sikhs, Hindus, and Sikhs who suffered persecution for their religion or lived in fear of it.

This amendment expedites the citizenship application process for immigrants who arrived in India by December 31, 2014, and who were subjected to religious persecution in their native country.

The new rule facilitates the naturalization process for non-Muslim migrants from Afghanistan, Bangladesh, and Pakistan. They now just need to reside in India for six years instead of twelve in order to be eligible for citizenship. According to an Intelligence Bureau inspection, these rules may help about 30,000 people.

Online Registration Process of CAA 2019

*Applying for citizenship will now be done online. There will be a committee in each district to carefully review all the applications. The head of this committee will be the Director in charge of Census Operations in each State. The committee will include officers from the Intelligence Bureau, the Post Master General, the State or National Informatics Centre, and a representative from the Department of Home. Additionally, the Divisional Railway Manager will also be invited to participate in the committee.

*The government has made the entire process online. An online portal has also been prepared for this. Applicant can also apply from his mobile phone. Applicants will have to state the year in which they entered India without documents. No documents will be asked from the applicants. All such pending cases related to citizenship will be converted online. Eligible displaced people will have to apply online only on the portal. After that the Home Ministry will investigate and issue citizenship.

Who will get citizenship?

The right to grant citizenship rests entirely with the Central Government. The Citizenship Act of 1955 has been amended to grant Indian citizenship to immigrants from Hindu, Sikh, Jain, Parsi, Buddhist and Christian communities of neighboring Afghanistan, Bangladesh and Pakistan. Such migrant citizens, who are fed up of religious persecution in their countries and have come to India and taken refuge before 31 December 2014. Under this law, those people are considered illegal immigrants, who have entered India without valid travel documents (passport and visa) or have entered India with valid documents, but for more than the prescribed period.

  • If you’re from India and want to become a citizen, you can apply for registration.
  • If you’re married to an Indian citizen and want to become a citizen yourself, you can apply for registration.
  • If you’re a minor child of an Indian citizen and want to become a citizen, you can apply for registration.
  • If your parents are already Indian citizens and you want to become a citizen, you can apply for registration.
  • If you or one of your parents was once an Indian citizen and you want to become a citizen again, you can apply for registration.
  • If you have an OCI (Overseas Citizen of India) Card and want to convert it to Indian citizenship, you can apply for registration.

  • Fill out the application form (Form VIIIA) with all your information and include the required documents.
  • Write a sworn statement (affidavit) confirming that all the information in your application is true.
  • Get another Indian citizen to write a sworn statement (affidavit) vouching for your good character.
  • Sign a statement declaring that you have sufficient knowledge of one of the languages listed in the Eighth Schedule of the Constitution.

Application Process

  • Fill out the application online and send it to the Empowered Committee through the District Level Committee assigned by the Central Government.
  • After you submit, you’ll receive an electronic acknowledgment (Form IX).
  • The District Level Committee, led by a designated officer, will check your documents.
  • The designated officer will have you take an oath of allegiance.
  • The signed oath and confirmation of document verification will be sent to the Empowered Committee.
  • If you don’t show up despite given chances, your application might be rejected.
  • Attach copies of specified documents (Schedule IA and IB) and an affidavit (Schedule IC) with your application.
